Flying Cargo Website-Terms of Use
Welcome to the Flying Cargo Ltd. Website (hereinafter "the Website" or "the Flying Cargo Website"). The Website is managed and operated by Tsomet Foreign Trade Computer Information Ltd. (hereinafter "Tsomet"), a subsidiary of Flying Cargo Ltd. (hereinafter "Flying Cargo").
The Flying Cargo Website is a site on the Internet, from which information about Flying Cargo's logistic services, including tracking information on shipments delivered for Flying Cargo's clients, can be obtained (hereinafter "the Information Service").
The Terms of Use appearing below (hereinafter "the Terms of Use") do not derogate from or replace any agreement and/or arrangement and/or any other terms, which exist or may exist in the future between Flying Cargo and the user of the Website (hereinafter "the User"), but are supplemental thereto.
The use of the Website is subject to the Terms of Use. The User should read the Terms of Use carefully before using the Website, since use of the Website constitutes the User's consent to the Terms of Use.
Website Content and the Information Service
Flying Cargo and Tsomet make considerable great efforts to assemble, process and present the data in the Information Service accurately and promptly upon receipt of the data by Flying Cargo. However, it is possible that mistakes and delays will occur in the process of assembly, processing and presentation and the User confirms that he is aware of that possibility and that he will have no demands or claims with respect thereto.
The Flying Cargo Website may offer links to other websites on the Internet (hereinafter " the Linked Websites "). These links are intended only to facilitate use of the Website by the User. Flying Cargo and Tsomet will not be liable for any information, content or other item provided by the Linked Websites. Further, the provision of the links shall not constitute any recommendation, approval or expression of preference by Flying Cargo and/or Tsomet of the Linked Websites or of any advertisement appearing on the Linked Websites and/or of the operators thereof.
Flying Cargo and/or Tsomet are entitled, in their absolute discretion, to remove any or all links existing at any time on the Website and have no obligation to add any new links to the Website.
Intellectual Property
All intellectual property rights in and with respect to the Website, including, without derogating from the generality of the aforegoing, the copyright in the Website and in the Website design, programs, applications, computer codes, graphic files, text and any other materials included in the Website, are and will remain the exclusive property of Flying Cargo (except for the rights in the source programs which are and will remain the property of Tsomet). Without the prior, written consent of Flying Cargo, any reproduction, modification, publication, broadcast, transfer, sale, distribution or any commercial or other use of the Website's content or any part of it is strictly forbidden, except for personal use by the User, according to the Terms of Use, of the information provided.
Privacy Policy
Accessing certain services on the Website requires registration. In order to register, the User will be required to provide personal identification information, including name, telephone number and e-mail address. Flying Cargo and Tsomet will be entitled to use the information provided by the User for the purpose of registration and/or in connection with the User's activities on the Website and any information collected by Flying Cargo and/or Tsomet with respect to the User's activity on the Website, as follows:
- to facilitate the activities of the User on the Website;
- for the provision of and in relation to the services supplied from time to time, whether through the Website or otherwise, by Flying Cargo or its affiliates to the User;
- for the maintenance of the Website and the monitoring of the User's activity on the Website;
- in accordance with the provisions of law or any agreement with the User , including any other provisions of the Terms of Use and the demand of any competent authority or court order;
- in enforcing any of the Terms of Use against the User;
- for contacting the User;
G. for statistical analysis and in order to supply statistical and other processed information to third parties, provided always that such information shall not reveal the User's identity.
Although Flying Cargo and Tsomet make efforts to protect the information that is provided by the User or is collected as aforesaid, it is agreed that the provision of information by the User is on the User's responsibility and the User will have no claims or actions against Flying Cargo and/or Tsomet, their directors, employees or any person or entity acting in their name or on their behalf, even in the event of disclosure or transfer of the said information other than for the purposes specified above.
The User hereby declares that he is aware and agrees that the Flying Cargo Website makes use of "cookies" files, in order to collect statistical data regarding the User's use of the Website and in order better to accommodate the needs of the User.
"Cookies" are text files which the User's browser creates upon command received from the Flying Cargo Website's computers and which are saved on the hard drive of the User's computer. These files contain a variety of information, such as the pages of the Flying Cargo Website which the User has visited, the length of time spent by the User on the Website, the location from which the User has accessed the Website, the sections and information that the User has asked to view while accessing the Website, etc.
The Services, Modifications and Termination
The services and information on the Flying Cargo Website are provided "as is" and cannot be modified to the needs of any individual.
The services on the Flying Cargo Website are provided free of charge and Flying Cargo and Tsomet are entitled to terminate the services on the Website, in whole or in part, at any time and without notice.
The Flying Cargo Website, as well as the Information Service, is constantly in a process of construction. It is agreed, accordingly, without derogating from any legal right, that Flying Cargo and/or Tsomet shall be entitled, from to time, to alter the Website structure, its form, the Terms of Use, the services, their frequency and scope and any other aspect thereof, without any duty to give prior notice. These alterations will be made, having regard, inter alia, to the dynamic nature of the Internet and the other technological developments in this field. Such alterations, by their nature, may result in failures, errors and the like.
Flying Cargo, Tsomet, their directors, managers, employees and any other party acting in their name and/or on their behalf, will not be bear any responsibility with respect to the Information Service and/or the Linked Websites and/or data appearing on the Flying Cargo Website and/or the Linked Websites, their accuracy and/or completeness and/or with respect to the use of the said data and/or reliance thereon by the User and/or anyone on his behalf and/or with respect to the termination of the services provided on the Website, in whole or in part and/or to with respect to alterations in the services and/or for any direct, indirect and/or any other damages caused by use and/or reliance as aforesaid and the User hereby waives all and any claims and actions against Flying Cargo and/or Tsomet, their directors, managers, employees and any other party acting in their name and/or on their behalf, with respect to the Flying Cargo Website and/or to the Linked Websites, including claims and actions relating to the use of and/or reliance on the data provided by them and/or any damages caused as a result of such use or reliance.
Jurisdiction
The use of the Flying Cargo Website and the Terms of Use are governed exclusively by the laws of the State of Israel. Any dispute arising from the Terms of Use or from the use of the Website is subject to the exclusive jurisdiction of the competent court in the District of Tel Aviv-Yafo, provided that Flying Cargo and Tsomet may take legal action in any jurisdiction in which the User has an address and/or a place of business and/or in which his assets or any part of them are located.
As stated above, your use of the Website constitutes your consent to the Terms of Use.
